The Supreme Court agreed to resolve whether parties in private arbitration outside the country are able to use U.S. courts to compel the production of evidence. The decision to grant the petition for certiorari, or review, on Dec. 10 in ZF Automotive US Inc. v. Luxshare Ltd., came after the high court blocked a lower court’s order in the legal proceeding on Oct. 27. That order would have forced a Michigan company to hand over documents to a Chinese manufacturer disputing the value of the assets of a business unit in the company’s German parent company that it purchased in 2017. On Dec. 10 the court ordered the case consolidated with AlixPartners LLP v. The Fund for Protection of Investors’ Rights in Foreign States, a similar case it had also agreed to hear.
