Plaintiffs in a lawsuit against Vice President Mike Pence on Wednesday asked the Supreme Court to intervene after a district court and an appeals court rejected the case. Rep. Louie Gohmert (R-Texas), Arizona’s Republican electors, and other plaintiffs filed an emergency application, requesting intervention from Supreme Court Justice Samuel Alito, a George W. Bush appointee. Plaintiffs asked the court to declare Vice President Mike Pence has the “exclusive authority” to reject contested electoral votes in the joint session of Congress on Jan. 6. They argue that several sections of the Electoral Count Act are unconstitutional in constraining a vice president’s power to do so during such a session.
