Arkansas Gov. Asa Hutchinson said on Sunday that his state’s near-total abortion ban, which he signed into law earlier this month, is designed to set the stage for the Supreme Court to review the legality of abortion under Roe v. Wade. “That was the whole design of the law. It is not constitutional under Supreme Court cases right now,” Hutchinson told CNN’s State of the Union. “I did prefer a rape and incest exception. I didn’t get a vote on that. And so I signed it because it is a direct challenge to Roe vs. Wade. That was the intent of it.” The law, known as the “Arkansas Unborn Child Protection Act,” bans providers from performing abortions “except to save the life of a pregnant woman in a medical emergency.” The law makes no exceptions for rape and incest.
