The Supreme Court ruled 6-3 this morning that previously deported illegal aliens again facing deportation who claim a fear of persecution or torture if they are removed to their countries of origin may be indefinitely detained by the government. Over the dissents of the three liberal members of the court, the court ruled those noncitizens are not entitled to a hearing about whether they should be released while the government processes their claims. Justice Samuel Alito wrote the court’s opinion in Johnson v. Guzman Sanchez, court file 19-897, which was made public June 29. Tae D. Johnson is acting director of U.S. Immigration and Customs Enforcement (ICE). Oral arguments took place telephonically Jan. 11. Alito was joined by Chief Justice John Roberts, along with Justices Brett Kavanaugh and Amy Coney Barrett.
