The chief justice of the Supreme Court late Wednesday tried to block a new law in Texas, arguing it might violate the U.S. Constitution. Justice John Roberts voted with the three justices appointed by Democrats to enjoin Texas Senate Bill 8, which bars abortions from being performed after a fetal heartbeat is detected outside of medical emergencies. The four, though, were outvoted by five Republican-appointed justices, who said the abortion provider plaintiffs had not “carried their burden” of making a showing that they would likely succeed in their lawsuit.
