The Wisconsin Supreme Court on March 31 struck down Gov. Tony Evers’s statewide mask mandate, ruling the Democrat overstepped his legal authority by declaring multiple states of emergency amid the COVID-19 pandemic. “The question in this case is not whether the Governor acted wisely; it is whether he acted lawfully. We conclude he did not,” Justice Brian Hagedorn wrote in the opinion. Evers initially declared a state of emergency in March 2020. He declared additional states of emergency in July and September. Evers has since issued new states of emergency on an ongoing basis. Jeré Fabick of the Heartland Institute sued Evers over the second and third declarations, asserting they were unlawful; four justices agreed.
